Is using my own Iowa insurance worth it after a Dubuque whiteout hit-and-run?
In Iowa, uninsured motorist and hit-and-run injury claims often settle in the roughly $15,000 to $50,000 range, and serious cases can be worth much more.
The insurance company will tell you this is a claim under your own policy, so it should be simple, quick, and limited to what they think your bills show right now. They may also act like a no-plate hit-and-run is too hard to prove, or pressure you to wrap it up before year-end so the file does not roll into a new reserve period.
What is actually true: if the driver who hit you on Highway 20, U.S. 61/151, or an icy Dubuque side street is unknown, that can still be an uninsured motorist (UM) claim under your own auto policy. A hit-and-run driver does not get a free pass just because nobody got a plate number.
The traps are timing and proof.
You need to give prompt notice to your insurer, and Iowa law generally requires immediate notice to police if there is injury, death, or apparent property damage of $1,500 or more. In Dubuque, that usually means calling Dubuque Police or the Iowa State Patrol if it happened on a state route. Get the report number.
Also, do not let them value the claim like it is just a sore neck if you are missing shifts, losing overtime, or still treating after a crash caused by a whiteout, overcorrection, or blown tire.
Focus on documenting:
- ER/urgent care records
- Missed work and lost wages
- Photos of vehicle damage and road conditions
- Witness names
- Your policy's UM/UIM limits
Iowa has no cap on personal injury damages in ordinary auto negligence cases, and the usual lawsuit deadline is 2 years. But your policy may impose much faster notice or claim deadlines. That is why waiting to see if it "gets better" is where people get exploited.
The information above is educational and does not create an attorney-client relationship. Every injury case turns on its own facts. If you're dealing with this right now, get a professional opinion.
